C/O form E là gì ?
C/O form E hay còn gọi là giấy chứng nhận xuất xứ mẫu E. Được áp dụng cho những loại hàng hóa nhập khẩu từ Trung Quốc về Việt Nam hoặc các nước thành viên ASEAN hoặc ngược lại sẽ được hưởng mức thuế ưu đãi theo hiệp định ACFTA. Mức thuế nhập khẩu sẽ được áp dung với từng loại hàng hóa cụ thể, căn cứ vào mã HS Code.
Nhờ có C/O Form E, hàng hóa sẽ được hưởng ưu đãi về thuế quan khi nhập khẩu vào các nước thành viên, từ đó giúp giảm chi phí và tăng tính cạnh tranh cho doanh nghiệp.
C/O Form E có tác dụng gì?
C/O Form E sẽ dùng để xác nhận nguồn gốc xuất xứ hàng hóa, từ đó xem lô hàng có được mức thuế ưu đãi theo hiệp định ACFTA. Cụ thể sẽ căn cứ vào mã HS Code và theo từng loại hàng hóa.
Tại sao cần C/O Form E?
- Hưởng ưu đãi thuế: Đây là lợi ích lớn nhất khi sử dụng C/O Form E. Nhờ có chứng từ này, hàng hóa sẽ được áp dụng mức thuế nhập khẩu ưu đãi theo quy định của hiệp định ACFTA.
- Thúc đẩy thương mại: Tạo điều kiện thuận lợi cho việc giao thương hàng hóa giữa các nước thành viên, góp phần thúc đẩy phát triển kinh tế.
- Đảm bảo tính minh bạch: C/O Form E giúp xác minh nguồn gốc xuất xứ của hàng hóa, đảm bảo tính minh bạch trong hoạt động thương mại.
C/O Form E dùng cho nước nào?
C/O Form E được dùng cho hàng hóa được nhập khẩu từ Trung Quốc về các nước ASEAN và ngược lại xuất khẩu từ các nước ASEAN đến Trung Quốc.
Quy định chi tiết về C/O form E hiện nay
Quy định chi tiết về C/O form E hiện nay được quy định trong nhiều văn bản pháp luật. Một số văn bản quan trọng liên quan đến C/O form E mà bạn nên tham khảo.
- Thông tư 36/2020/TT-BCT của Bộ trưởng Bộ Công Thương ban hành.
- Thông tư 35/2012/TT-BCT và Thông tư 14/2016/TT-BCT bổ sung tên Tổ chức, do bộ Bộ Công Thương uỷ quyền cấp C/O ban hành.
- Thông tư 21/2014/TT-BCT sửa đổi bổ sung Quy tắc cụ thể mặt hàng được quy định trong Thông tư 36.
- Công văn 12149/BCT – XNK của Bộ Công Thương về hóa đơn bên thứ ba trong ACFTA.
- Quyết định số 12/2007/QĐ-BTM: Quy chế cấp Giấy chứng nhận xuất xứ hàng hóa mẫu E.
- Thông tư 06/2011/TT-BCT về thủ tục cấp Giấy chứng nhận xuất xứ hàng hóa ưu đãi.
Hồ sơ xin cấp C/O form E gồm những gì?
Hồ sơ xin cấp C/O form E bao gồm những hồ sơ sau:
- Đơn đề nghị xin cấp C/O Form E
- Mẫu C/O đã được đầy đủ thông tin
- Tờ khai hải quan xuất khẩu
- Hợp đồng mua bán (bản sao hợp đồng mua bán hàng hóa)
- Hóa đơn thương mại
- Packing list
- Bảng giải trình quy trình sản xuất
- Bill of Lading
- Các giấy tờ khác: Tùy theo yêu cầu của cơ quan cấp có thể yêu cầu thêm các giấy tờ khác như chứng nhận chất lượng, giấy phép xuất khẩu...
Nội dung của C/O form E
Theo phụ lục 4 của Thông tư số 36/2010/TT-BCT. Nội dung của C/O form E bao gồm:
Ô số 1: Thông tin giao dịch người xuất khẩu, địa chỉ, tên quốc gia xuất khẩu (Việt Nam)
Ô số 2: Thông tin của người nhận hàng, địa chỉ, tên nước nhận hàng.
Ô trên cùng bên phải: Tổ chức cấp C/O sẽ ghi ở mục này. Số tham chiếu gồm 13 ký tự, chia thành 5 nhóm.
Ô số 3: Thông tin ngày khởi hành, tên phương tiện vận tải, tên cảng bốc dỡ hàng
Ô số 4: Để trống
Ô số 5: Danh mục hàng hóa
Ô số 6: Số và ký hiệu của kiện hàng
Ô số 7: Số lượng kiện hàng, loại kiện hàng, mô tả hàng hóa
Ô số 8: Ghi theo hướng dẫn:
- Ghi “WO”: hàng hóa có xuất xứ thuần tuý hoặc được sản xuất toàn bộ tại nước xuất khẩu
- Ghi tỷ lệ phần trăm nếu hàng hóa có xuất xứ không thuần tuý.
Ô số 9: Trọng lượng và số lượng hàng hóa, giá FOB
Ô số 10: Số và ngày cấp hóa đơn
Ô số 11:
- Dòng thứ nhất ghi chữ “Vietnam”
- Điền thông tin nước nhập khẩu.
- Dòng thứ ba ghi địa điểm cấp, ngày tháng năm, chữ ký của người được uỷ quyền.
Ô số 12: Bạn không cần điền vào mục này. Mục này được dùng cho tổ chức cấp C/O ghi.
Ô số 13: Tick vào ô tương ứng
Ngoài ra, đối với C/O form E 3 bên thì:
Ô số 1: Nhà sản xuất phải ở quốc gia tham gia ACFTA (vd: China)
Ô số 7: Thông tin công ty phát hành hóa đơn. Tên nước cụ thể mà công ty đang đặt trụ sở
Ô số 10: Số và ngày hóa đơn phải được ghi rõ chi tiết
Ố số 13: Cần phải tick vào mục Third Party Invoicing.
Cách kiểm tra CO form E hợp lệ
Có hai cách để kiểm tra C/O form E hợp lệ hay không?
Cách 1: Tra cứu trực tuyến
Bước 1: Truy cập trực tiếp và website: http://check.ccpiteco.net/
Bước 2: Điền chính xác thông tin tại các mục sau:
- C/O Certificate No: điền số Certificate No
- C/O Serial No: điền vào 11 số cuối.
- Security Code: điền vào verification code
Bước 3: Ấn nút Search. Khi đó kết quả sẽ được trả về.
Cách 2: Gọi trực tiếp đến cơ quan có thẩm quyền cấp C/O form E để tra cứu.
Quy trình xin cấp C/O form E
Bước 1: Đối với các doanh nghiệp lần đầu xin cấp C/O. Vui lòng đăng ký tài khoản mới cho doanh nghiệp tại https://ecosys.gov.vn
Bước 2: Sau khi có tài khoản, doanh nghiệp tiến hành truy cập hệ thống và khai báo hồ sơ
Bước 3: Tải các chứng từ như tờ khai hải quan, vận đơn, Invoice lên hệ thống
Bước 4: Thực hiện ký điện tử và gửi hồ sơ
Bước 5: Hồ sơ được duyệt, kết xuất và in đơn xin C/O đã cấp và nộp cùng bộ hồ sơ trực tiếp tại Bộ Công Thương
Bước 6: Hồ sơ giấy được duyệt và cấp C/O gốc.
Những lưu ý khi xin cấp C/O form E
Khi xin cấp C/O form E cần phải lưu ý những vấn đề sau đây:
- Đơn đề nghị cấp C/O và C/O form E phải được khai đầy đủ theo quy định và được ký bởi người có thẩm quyền.
- Xuất xứ hàng hóa phải phù hợp với quy định của Thông tư 12/2019/TT-BCT của Bộ Công Thương
- Mọi thông tin khác trên C/O form E phải phù hợp với chứng từ kèm theo.
- Mô tả hàng hóa, số lượng, trọng lượng, ký hiệu và số kiện hàng, số kiện và loại kiện hàng được kê khai phù hợp với hàng hóa xuất khẩu.
Các sai sót thường gặp đối với CO Form E
Một số lỗi thường gặp đối với C/O Form E, như:
- Ghi sao thông tin của bên xuất khẩu và nhập khẩu.
- Cấp sai C/O form E cho bên thứ ba.
- Sai các thông tin liên quan đến hàng hóa.
- Sau thông tin trên C/O so với thông tin trên nhãn mác hoặc so với hàng hóa thực tế.
- Chữ ký hoặc con dấu của người cấp C/O không giống với thông tin đã đăng ký.
- C/O form E cho bên thứ ba nhưng không điền vào ô số 13.

- Thời gian làm thủ tục tầm bao lâu?
Thời gian cấp C/O Form E thường từ 3-5 ngày làm việc, tùy thuộc vào từng trường hợp cụ thể.
- Hạn sử dụng của C/O Form E trong bao lâu?
Thông thường, C/O Form E có hiệu lực trong vòng 12 tháng kể từ ngày cấp.
- Cách sửa đổi thông tin trên C/O Form E
